Mandate and legal basis
The commission is an extra-parliamentary federal body. Its activity is based on Article 18a of the Cultural Property Transfer Act and on the Ordinance on the Commission for Historically Problematic Cultural Heritage (available in French, German and Italian), which regulates the organisation, duties and operation of the commission.
The mandate of the commission comprises:
- Advising the Federal Council and Federal Administration on historically problematic cultural heritage.
- Advising the Federal Council and Federal Administration on historically problematic cultural property in the possession of the Confederation.
- The submission of non-binding recommendations in specific instances upon request.
The commission has no decision-making or enforcement powers.
